CGENERAL AND SPECIAL CONDITIONS OF SALE OF H2O ODYSSÉE

The general and special conditions of sale are recognized read and approved at registration to any of the activities on the site H2o Odyssée. They define the rights and obligations of the parties in connection with the remote booking of the services offered by H2o Odyssée, the details of which are specified in this document. The customer acknowledges having read and accepted these terms and conditions of sale.

1 / TERMS OF REGISTRATION & VALIDATION

1.1 Know how to swim and be healthy

Adults, adolescents and children (or the legal representative for minors) attest to their ability to swim at least 25 m and to immerse themselves. Do not present medical contraindications to the practice of kayaking.

You acknowledge having the ability and level requested for the chosen exit.

1.2 Booking on the H2o Odyssey website

Book and confirm your reservation directly on the site by a secure online payment.

Your registration / reservation is automatically confirmed by email upon receipt of payment of the deposit, or full payment of the service when booking.

1.3 Quota required

"Standard Excursion" services are subject to a minimum registration quota of 4 or 6 people, because of the preferential rates applied for all the services of this product.

2 / EQUIPMENT & SUPERVISION

Amenities provided: Kayak and canoe, paddle, skirt, vest, whistle and mirror safety, waterproof bag, and other safety equipment.

Our rates include coaching by an experienced guide, certificated State of Canoe Kayak.

3 / INSCRIPTIONS // RESERVATIONS & PAYMENT METHODS

3.1 For half day: +/- 3 hours

The deposit * paid validate your pre-booking, and your registration will be validated only after the partial payment, or total, on the site of H2O Odyssée.

More than 8 days before delivery: 20% deposit payment *.

From 7 days to the day of delivery: payment of the total amount, or the balance, under pain of cancellation of your pre-booking (see 4.1.1).

Secure online payment is the most suitable. All methods of payment are accepted: CB, transfer, checks or cash.

3.2 For a day

The deposit * paid validate your pre-booking, and your registration will be validated only after the total payment, on the site of H2O Odyssée.

More than 21 days of departure: payment of a deposit * of 20%. of the service for a pre-booking.

From 20 to 8 days before day J. departure: payment of the balance or the totality of the service.

From 7 days to the day of the service: payment of the total or the balance, under penalty of cancellation of your pre-registration (see 4.1.2).

3.3 Standard product of more than one day & stay

The deposit * paid validate your pre-booking, and your registration will be validated only after the partial payment, or total, on the site of H2O Odyssée.

1ère option in three installments:

More than 30 days of departure: payment of 20% deposit * of the service for a pre-reservation.

From 29 to 21 days before the service, 2 th deposit of the 30% deposit of the totality that confirms your reservation.

From 20 to 8 days before day J. departure: settlement of the 50 balance% of the totality of the service.

If the balance has not arrived before 7 days before the day of departure, the pre-booking and booking is considered canceled by you (see 4.1.3).

2th option in two installments:

More than 21 days before the service: payment of 50% deposit * of the service for a reservation.

From 20 days to 8 days before the delivery, settlement of 50% balance of the totality of the service.

If the balance has not arrived before 7 days before the day of departure, the pre-booking and booking is considered canceled by you (see 4.1.3).

In case of late registration less than 20 days before delivery: payment of the totality.

Access to the group preferential rates and commercial offer for all registrations remains valid until 21 days before the day of departure. Beyond this deadline, the codes will no longer be active and valid.

3.4 Excursion in "EXCLUSIVITY" and Excursion on "MEASURE"

"Exclusive" and "Measure" services are subject to consultation and agreement between the client and the service provider. They differ from the "Standard Excursion" services.

3.5 Product «KAYAK RENTAL»

At more than 7 days of the rental, payment of a deposit * of a value of 30% of the total price of the rent (possible complementary insurance included). The balance will be paid no later than 48 hours before the rental subject to cancellation.

Less than 2 days of the rental, payment of the totality.

4 / CONDITIONS CANCELLATIONS & CHANGES

4.1 CANCELLATION BY CUSTOMER

All cancellations must be sent by e-mail to H2O Odyssée. Cancellation fees will be charged according to the date of cancellation and the service (half day, and +/- one day), and entails the application of the following scale:

4.1.1 Cancellation fee / "half day" service: +/- 3 hours

More than 8 days before delivery: no fees.

From 7 to 2 days before delivery: 20% of the output.

Less than 24 hours before the day of delivery: 100%.

A contract assignment *, free of charge, is possible subject to the appropriate level of the transferee, or a postponement date of the service, which will be established and validated in consultation with the client and the service provider, within a period of three months.

4.1.2 Cancellation fee / "one day" service

More than 21 days before delivery: no fees.

From 20 to 8 days before delivery: 20% of the output.

From 7 days to 2 days before delivery: 50% of the amount of the benefit.

Less than 24 hours before the day of departure: 100% of the amount of the service.

A contract assignment *, free of charge, is possible subject to the appropriate level of the assignee. It is also possible to postpone, without charge, the service that will be established and validated in consultation with the client and the provider, within three months.

4.1.3 Cancellation / "more than one day & stay" fee

More than 31 days before delivery: no fees.

From 30 to 21 days before departure day: 30% of the service.

From 20 to 8 days before departure day: 50% of the service

From 7 days before the day of departure: 100% of the service

In the event that H2 O Odyssée has already incurred booking fees (transportation or accommodation ...) following your registration, the prorate of your participation in these fees, will be deducted from the amount to be refunded. And, in the case of a possible "group rate negotiated" at the time of registration, the amount of the discount granted will also be deducted from the amount to be refunded. The discount granted is not carried over to another outing. In case of force majeure cancellation justified, it will be proposed a date, see two dates maximum of report of the output, to be validated and confirmed by email by the customer, and to be carried out within a three months. A credit (or a credit) is possible on another service proposed in the catalog of activities, and the calendar, to be defined between the two parts, or a refund within a period of three months.

4.1.4 Change or modification of the service

Any request for change or dates of the benefit of the participant must be notified as soon as possible by any means to obtain an acknowledgment of receipt.

It is possible to agree a solution to your request. See the deadlines indicated below:

At the latest: 8 days before a delivery of +/- 1 day.

At the latest: 21 days for benefits of more than one day.

4.1.5 Transfer * of contract

In case of transfer of contract to a third party, the customer must notify it no later than 7 days before the exit by any means to obtain an acknowledgment of receipt. This assignment is possible subject to the appropriate level of the transferee.

4.1.6 Discontinuation of service and unused services

Any service interrupted by the participant (for reasons of health, level, or other) does not entitle to any refund by H2 Odyssey unused services. Any costs incurred by the participant will not be reimbursed. The customer can eventually get closer to his own cancellation insurance, according to the terms of the contract.

4.1.7 Customized and exclusive product

Customized and exclusive products are subject to consultation and agreement between the customer and the service provider. They differ from the product "Standard Excursion".

4.2 AMENDMENT / CANCELLATION BY PROVIDER

The Guide Moniteur reserves the right to make changes, or postpone the output in case of adverse weather, environmental force majeure, due to insufficient level and skill of the group or the insufficient number of participants.

4.2.1 Security Change

WEATHER: If the weather conditions did not allow to carry out the course initially planned, another navigation on a less exposed part of the coast will replace the said exit become too dangerous for the group.

H2O Odyssée, or the guide-monitor, remains alone to judge this eventuality, without notice.

OTHER: For technical reasons (safety), for the skills and the insufficient level of the group, for environmental reasons, etc ... and without notice.

The modification of the program is studied in consultation between the guide and the participants. However, the final decision belongs to the organizer, without being questionable by the group. 4.2.2 Modification for insufficient participants:

The "Standard Excursion" services are subject to a minimum number of 4 registrations, due to preferential rates applied for all the services of this product. In case of an insufficient number of 4 people, you will be informed at the latest 2 days before the exit by e-mail or telephone.

A postponement on one or two maximum dates, and / or a credit of the sums paid, or a transfer of contract to validate and to carry out within a period of 3 months. The credit (credit) of the corresponding sum is possible on another service offered in the catalog of activities and calendar, and remains to be defined and confirmed by mail between the two parties, within three months. The participant may request the refund of the sums paid. He can not claim any compensation. These terms and conditions are valid for all outdoor activities. 4.2.3 Privatization "small group"

In order to avoid canceling a service for lack of required participants, H2o Odyssée in setting up "Privatized" outings

The small group has the choice to opt for a "Privatized" exit under the conditions studied below:

Calculation method: Individual tariff multiplied by 4, then divided by 3, to which a discount of 10% applies on the calculated amount in case of a group of 3 participants. Identical calculation for a small group of 2 participants, but 15% discount.

The departure date can be maintained in case of acceptance to this proposal.

5 / ACCEPTANCE OF RISKS & COMPLIANCE

5.1 Events outside H2o Odyssey

The risks inherent in all outdoor sports are potentially real, whether predictable or not, weather-related and other acts of nature, more or less serious injuries, deaths ... You accept the risks by participating voluntarily and you assume the possible consequences. (Heat, tropical rain and wind, contact with poisonous corals or plants, poisonous and / or aggressive animals, various wounds ...)

5.2 Rules of prudence

The safety instructions must be observed, their non-compliance may cause the guide to exclude from the group the defaulting participant (s). H2o Odyssée reserves the right to exclude, at any time, one or more participant (s) whose behavior would endanger the safety of the group or its well-being, without any compensation being due to the offending participant. H2o Odyssée will not be held responsible for non-compliance with safety rules or negligence during a boat trip.

5.3 Prerequisites and technical levels

At registration each participant recognizes to know how to swim. He also acknowledges having a physical condition and a level of technicality corresponding to the criteria of levels specified for indicative purposes in the technical sheet of inscription of the corresponding service. H2o Odyssée reserves the right not to accept a participant who does not meet the level criteria. H2o Odyssée can not be held responsible in case of physical insufficiency revealed during the outing.

5.4 Engagements

In order to offer you quality services, H2o Odyssée makes commitments with other providers, (transport, accommodation, etc ...) and expenses resulting from the implementation of the preparation and logistics. (See 4.1.Cancellation by the customer).

The participant agrees to accept unexpected situations and the possibility of a program change.

H2 O Odyssée simply asks you to host your adventure with an open and responsible spirit.

6 / HARDWARE

6.1 Materials provided

The materials and equipment provided by H2o Odyssée are entrusted to the participant who becomes responsible for the duration of the service. Any deterioration may result in repair or replacement costs. As such, the participant is advised to ensure that his or her personal liability insurance policy covers any damages incurred during a sea kayak or canoe trip.

6.2 Personal material.

The equipment to be provided is listed in the technical sheet of the corresponding service. It is important to control your equipment. Your safety and comfort as well as the smooth running of the service may depend on it. The customer is solely responsible for his personal equipment.

7 / PRICE OF SERVICES

7.1 Prices include

The prices of H2o Odyssée's services include the supervision by an experienced guide graduated State Patent, the loan of the navigation equipment and the corresponding equipment. In some cases, prices may include: the loan of camping or camping equipment, catering, transportation by minibus.

It is up to the customer to refer to the technical sheet of the chosen service to know the exact list of services included and the list of equipment to provide.

The prices of H2o Odyssée's services have been calculated as accurately as possible according to the economic conditions known at the time of publication of the rates on the booking platform. They are applicable from publication to the day of the next update.

8 / INSURANCE

H2O ODYSSÉE has subscribed a Professional Civil Liability with the General Insurance Company Paci fi c NC.

However, it does not replace the individual civil liability that each participant must hold and must be able to justify.

The participants remain responsible for the material and equipment entrusted to them.
